The Naval Supply Systems Command, Fleet Logistics Center Jacksonville, plans to award a sole source contract to Beechcraft Corporation for data rights and royalty fees related to the T-44 and T-34 aircraft through a Data License Agreement (DLA). Beechcraft, as the Original Equipment Manufacturer (OEM), exclusively holds the intellectual property, design analyses, testing, and technical data necessary for the support, modification, and repair of these aircraft models. This licensing agreement will provide the U.S. Navy access to Beechcraft’s technical data, including specifications and structural drawings, essential for depot-level maintenance performed at Fleet Readiness Center Southeast (FRCSE). Royalty fees will be charged for each aircraft inducted into the FRCSE to uphold the necessary technical support critical to the Chief of Naval Air Training’s Fleet Support Team mission. The agreement will remain valid for the entire contract duration, including all option periods. This procurement is conducted under Simplified Acquisition Procedures as a sole source due to the unique nature of the OEM’s proprietary data. The relevant NAICS code for this contract is 541330, Engineering Services, with a size standard of $15 million. Although this contract is intended for award to Beechcraft, the notice invites responses from any interested parties with substantive evidence demonstrating their capability to meet the requirements, ensuring the Government has the opportunity to consider competitive alternatives. However, if no suitable alternatives are presented within 10 calendar days of the notice, the sole source award to Beechcraft will proceed. The notice serves informational purposes and aims to maintain vigorous competition where feasible while acknowledging Beechcraft’s exclusive rights and technical expertise on the T-34 and T-44 aircraft.

Full Description

The Naval Supply (NAVSUP) Systems Command, Fleet Logistics Center Jacksonville (FLCJ), FL intends to issue a sole source award utilizing Simplified Acquisition Procedures to Beechcraft Corporation for data rights and royalty fees via a Data License Agreement (DLA) for the T-44 and T-34 Aircraft. Beechcraft is the only source that can provide this requirement because they are the Original Equipment Manufacturer (OEM) for the T-34 and T-44 aircraft. As the OEM, Beechcraft owns all of the data rights, extensive pre and post-construction design analyses, testing, and results. Without the OEM’s intellectual properties, historical information, and relevant data resources, the U.S Navy’s T-34 and T-44 Trainer Fleet operations, modifications, and repair will come to a halt and the FRCSE’s ability to sufficiently support the Navy’s aircraft fleet demands and requirements would be negatively impacted. This requirement is to provide technical data usage via a Data License Agreement (DLA) including Royalty Fees assessed for each T-44 and T-34 Aircraft inducted into the Fleet Readiness Center Southeast (FRCSE) as needed to accomplish the mission in support of the Chief of Naval Air Training (CNATRA) Fleet Support Team (FST) and FRCSE. The Data License Agreement shall set forth the terms and conditions which shall apply to the licensing of the technical information and services provided by Beechcraft to the Government in support of the program. This agreement shall be in effect throughout the life of the contract (including all option year periods). Technical data usage includes access to Beechcraft specifications, structures, and systems drawings. Technical data usage will be limited in scope to aircraft inducted for Depot-level maintenance at Fleet Readiness Center Southeast (FRCSE). A royalty fee will be assessed for each T-34 and T-44 inducted into FRCSE. The applicable North American Industrial Classification System Code (NAICS) code that this work falls under is 541330 Engineering Services, with a size standard of $15M. This notice of intent is for information purposes only. All sources eligible to provide this requirement must respond in writing. Responses must be supported with clear and convincing evidence to clearly articulate the ability to provide this requirement as outlined above. A request for documentation will not be considered as an affirmative response. If no responses are received, within 10 calendar days after publication of this notice, to the effect that comparable items are available, and that it is more advantageous to the Government than obtaining this product through a sole-source contract, then a sole source acquisition award will be made. Response to this notice is to be sent to contact@example.gov.
