This contract is a sole-source award under FAR 12.102(b) for emergency temporary air conditioning services at the DC Armory Drill Floor, justified by the urgent need to restore interior cooling after a prior contractor failure and to support critical operations during the summer of 2026. The procurement, conducted under 41 U.S.C. 1901 and administered by the U.S. Army Corps of Engineers through USPFO-DC-C, was awarded to Aggreko, LLC due to its unique, irreplaceable familiarity with the facility’s specifications and prior successful installations, which make it the only vendor capable of mobilizing, installing, and commissioning a 1,000-ton temporary HVAC system within a five-day window. The contract is structured as a firm-fixed-price award with no competitive solicitation, and pricing was determined fair and reasonable through historical comparison and government estimates without requiring certified cost or pricing data. Performance is scheduled from June 8, 2026, through September 30, 2026, with all equipment, labor, materials, delivery, and daily operations fully included in the turnkey solution. The place of performance is the DC Armory in Washington D.C., where the system must maintain habitable temperatures throughout the period to ensure the safety and functionality of high-attendance events. Acceptance is made at the installation site by the Government after successful commissioning, with no formal quality standards specified beyond functional performance and continuity of service. No packaging, marking, invoicing, or payment details are provided, and while no standard FAR clauses, inspection criteria, or special requirements are explicitly listed, the contract includes an implied condition to return future procurements to the SBA 8(a) program. The contracting officer and technical representative certified the urgency and necessity of the award, and the offeror, Aggreko, LLC, is recognized as a commercial firm not affiliated with any socioeconomic set-aside program.
