AI Contract Overview
The Drug Enforcement Administration (DEA) is awarding a firm-fixed price sole source order to ProAmpac for the acquisition of evidence bags, justified under FAR 13.106-1(b)(1)(i) due to the unavailability of any other source capable of meeting the agency’s unique operational requirements. The procurement is governed by the DEA’s internal OMPP SSEE Evidence Bag Program, which mandates that the bags be substantially rigid, durable, completely sealable, and resealable via heat-sealing to ensure evidence integrity and tamper resistance throughout handling and storage; no external military or federal standards are cited, as compliance is based solely on proven performance under DEA’s forensic processing conditions. ProAmpac is the only vendor whose product has demonstrated consistent reliability in DEA field and laboratory use, with competing products failing due to seal defects and material degradation. The place of performance is Springfield, Virginia, 22152, where final delivery and acceptance will occur, although the contractor’s address is in Cincinnati, Ohio. The acquisition, identified by solicitation number D-26-FS-0222 and NAICS code 326111, was issued as a special notice with no set-aside, and no competitive procurement will be conducted given the sole source determination. Capability statements from other potential suppliers were accepted only for information purposes up to May 21, 2026, and must be submitted electronically to Ms. Angel Barkley at the DEA. The contract includes no specified period of performance, delivery schedule, FOB terms, or detailed pricing data, and while government certification of conflict of interest compliance under 5 CFR § 2635 has been secured, no formal FAR clauses, inspection criteria, invoicing procedures, accounting codes, or contractor representations are outlined in the documentation. The award is based exclusively on the unique, non-replicable technical performance of ProAmpac’s evidence bags, with no trade-off or competitive evaluation conducted.
