The contract pertains to a 2007 solicitation for HIV/AIDS prevention and intervention services targeting girls at risk for juvenile delinquency. Initially posted on June 12, 2007, the solicitation aimed to award up to ten contracts, each not exceeding the Simplified Acquisition threshold, and was set aside entirely for small businesses under Federal Acquisition Regulation (FAR) Subpart 13. However, the solicitation was removed from the Federal Business Opportunities website just two days later due to legal challenges concerning the lack of a set-aside for service-disabled veteran-owned small business concerns. In response, the Department of Health and Human Services proactively canceled this solicitation and planned to conduct market research to assess the availability and competitiveness of service-disabled veteran-owned and HUBZone small businesses capable of delivering the required services. Following cancellation, a Sources Sought synopsis was posted on June 15, 2007, coinciding with the original solicitation number, to gather capability statements from interested businesses. This synopsis was set to close on June 25, 2007, after which the Government intended to evaluate responses and potentially revise the acquisition strategy to include additional set-asides before re-issuing the solicitation. The re-posting was anticipated for early July, signaling the government's effort to promote inclusivity and competition among diverse small business categories while ensuring the delivery of critical HIV/AIDS intervention services to the specified at-risk population.

Full Description

Solicitation 07T070028 titled 2007 HIV/AIDS PREVENTION AND INTERVENTION SERVICES FOR GIRLS AT RISK FOR JUVENILE DELINQUENCY was posted on the Federal Business Opportunities website June 12, 2007 with a response date of July 12, 2007. The solicitation was deleted from the website June 14, 2007. The solicitation stated that the Government anticipated making ten awards not to exceed the Simplified Acquisition threshold in accordance with Federal Acquisition Regulation (FAR), Subpart 13, Simplified Acquisition Procedures. The solicitation was solicited as a total small business set aside in accordance with FAR 13.003(b)(1). The Department of Health and Human Services was challenged on its decision to not set aside a similar requirement for service-disabled veteran-owned small business concerns and that solicitation was canceled. Based on that decision, a pro-active decision was made to also cancel solicitation 07T070028 and post a Sources Sought synopsis for market research purposes to see if there are service-disabled veteran-owned small business concerns or HUBZone small business concerns that have the core competencies necessary to provide the services being solicited and to determine if there is sufficient competition to make further set asides beyond a total small business set aside. Prior to issuing an amendment to cancel the solicitation, it was deleted from the FedBizOpps website. A Sources Sought synopsis was posted June 15, 2007 under number 07T070028, the same number that was assigned to the solicitation that was deleted. The synopsis will close June 25, 2007. Following evaluation of any capability statements submitted, the Government will re-announce the requirement and post the solicitation. It is anticipated that the re-posting will occur in early July.
