Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement Public Service and Procurement Canada - Environment Department (PSPC) has a requirement for the provision of services to recover and redeploy one (1) Hydrophone used for acoustic recording approximately 100 km off the west coast of Vancouver Island near Tofino. This Hydrophone is specialized for marine applications and contains very sensitive equipment which requires specific recovery techniques utilizing special lifting apparatus’. 3. Minimum Essential Requirements Any interested supplier must demonstrate by way of a statement of capabilities that it can provide the service that meets the following: 1. Must have a vessel of at least 50m in length capable reaching the hydrophone location approximately 100km west of Tofino and performing stationary lifts in a variety of sea states. 2. Must have a vessel crew with experience in offshore scientific and research operations and deployment and recovery of deep water moored scientific equipment. 3. Must have vessel with Global Positioning capability to maintain position for long periods of time 4. Must have vessel deck lay down space of at least 10’ x 36’ to secure the hydrophone, buoy, and mooring system for secure transit to a shore based facility for assessment and repair. 5. Must have vessel lifting equipment that handles up to 5,000kg and items up to 1800kg each for free lifting. 6. Must have a shore based warehouse for maintenance and long term storage of the buoy. 7. Service must be provided by Sept 30, 2022. 4.Applicability of the Trade Agreements This procurement is subject to the following trade agreements: - Canadian Free Trade Agreement (CFTA)
5.Justification for the Pre-Identified Supplier The pre-identified supplier, is the only supplier known that can provide the service that meets PSPC Environments operational requirements.
6.Government Contracts Regulations Exception The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".
7.Exclusions and/or Limited Tendering Reasons The following limited tendering reasons are invoked: • Canadian Free Trade Agreement (CFTA) - Article 12(b) - "where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists";
8.Ownership of Intellectual Property Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.
9.Period of the proposed contract or delivery date The service must be delivered on or before Sept 30, 2022.

If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
