The United States Department of Labor (DOL) intends to negotiate and award a Firm Fixed Price contract with the Washington Area Metropolitan Transit Authority (WMATA). This proposed noncompetitive action provides access to WMATA's automated Smart Benefits System to be used in support of the Mass Transportation Transit Subsidy Program and the Smart Benefits Program currently used by the Department of Labor for its employees' subsidies. Smart Benefits are the only form of fare media accepted by the District of Columbia METRO system and all other public transportation providers in the Washington, D.C. area. The sole source determination is based on FAR 6.302-1 - Only One Responsible Source and No Other supplies or Services Will Satisfy Agency Requirements. Smart Benefits will be purchased on a monthly basis for a period of one (1) year and two (2) one (1) year option periods. Fare media shall be purchased in compliance with Executive Order 13150 providing direct employer benefit to employees utilizing approved public transportation. This notice of intent is not a request for competitive quotations; however, responses received by 12:00 PM Eastern on 17 September will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining the feasibility of a competitive procurement.
