The United States Environmental Protection Agency (EPA) Region 9 plans to award a sole source purchase order to Ohio Lumex Co. Inc. for the acquisition of two RA915M Mercury Analyzers. This purchase is being made under the authority of the Federal Acquisition Regulations, specifically Subpart 6.302-1 relating to other than full and open competition, and FAR Part 13, Simplified Acquisition Procedures. The RA915M Mercury Analyzers are essential to meet an EPA mission objective of deploying the most reliable and accurate analytical equipment in the field while maintaining equipment consistency across the agency. The Emergency Response Technical Group (ERTG), a national EPA workgroup responsible for evaluating emergency response equipment, has vetted and approved this specific analyzer, which is manufactured by Ohio Lumex Co. Inc. The EPA asserts that Ohio Lumex is the only source capable of providing this equipment, ensuring compatibility with existing mercury analyzers in Region 9’s inventory. This notice is not a request for quote, nor will a solicitation be posted, but serves to determine whether other capable sources exist. Interested parties who believe they can supply comparable analyzers must submit a detailed written explanation of their capabilities and qualifications within ten business days, providing sufficient detail to assess competition feasibility. Submissions that only request a copy of the statement of work or offer basic corporate information will not be considered. Inquiries must be made in writing and directed to the EPA Contracting Officer, Rolando Camerino, via email. The received information will solely inform the decision on whether to pursue competitive procurement, as the current intent is to proceed with a sole source award based on the unique status of Ohio Lumex Co. Inc. as the equipment manufacturer recommended by the ERTG.
