AI Contract Overview
The Department of Energy’s National Energy Technology Laboratory intends to award a sole-source purchase order to Lithos - Element3 for a plug-and-play modular skid-based test bed designed to evaluate and accelerate emerging mineral extraction technologies. This decision is based on Element3’s exclusive possession of proprietary intellectual property, a uniquely designed system that removes key barriers for innovators in the field, and proven operational capabilities derived from continuous use of a substantially similar system already in operation. The test bed is critical for streamlining the assessment of critical mineral extraction technologies, and market research has confirmed no other known source can meet the specified requirements. Delivery is anticipated within 24 weeks of contract award. This notice of intent is not a solicitation and does not obligate the government to proceed without competition, but it provides an opportunity for other potential offerors to demonstrate their capability to fulfill the requirement by 4:30 PM EDT on July 23, 2026. Interested parties must submit written evidence of their ability to meet the technical specifications to Stefanie Page at stefanie.page@netl.doe.gov; telephone responses will not be accepted. The NAICS code for this action is 334516, and all submissions will be reviewed solely to determine whether competitive procurement is warranted. The government retains full discretion over whether to proceed with sole-source award or open the requirement to competition.

Full Description
In accordance with Revolutionary FAR Overhaul (RFO) Part 12, Acquisition of Commercial Products and Commercial Services, the Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to negotiate and award a purchase order on a sole source basis to Lithos - Element3 to purchase a plug-and-play modular skid-based test bed to evaluate and accelerate the deployment of emerging mineral extraction technologies because Element3 holds intellectual property patent rights portfolio; offers uniquely designed, "plug-and-play" skid-based test bed solution that directly addresses a significant barrier to entry for innovators in emerging mineral extraction technologies and offers significant operational benefits that streamline the evaluation process for critical mineral extraction technologies; and possesses a unique technical capability that consists of operational knowledge, field-validated design templates, and process performance data derived from continuous operation of a substantially similar skid system currently in operation. The anticipated period of performance for this requirement is delivery 24 weeks after award. This is considered a sole source to Element3 because, to the best of the NETL’s knowledge, based on market research conducted Element3 is the only known source that can provide this type of service. No known potential alternate sources exist which could satisfy NETL's requirement.
This notice of intent is not a request for quote/proposal. Any interested party that believes it is capable of meeting the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 4:30 PM EDT on July 23, 2026. Responses must be submitted in writing to the Contracting Specialist, Stefanie Page, via email at stefanie.page@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received.
A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
