Justification for Other then Full and Open Competition - DMC Construction MATOC Ceiling Increase

The 414th Contracting Support Brigade, Regional Contracting Office in Vicenza, Italy, has increased the maximum ceiling value of the Darby Military Community (DMC) Construction Multiple Award Task Order Contract (MATOC) from $15 million to $20 million to address urgent infrastructure needs across U.S. Army installations in Italy. This action, justified under FAR Subpart 6.3 as an other than full and open competition, is based on unusual and compelling urgency as defined by FAR 6.103-2, necessitating immediate repairs to critical facilities such as roofs on Buildings 5803/5804 and structural elements in Buildings 3051–3053 to prevent degradation of Army Prepositioned Stocks (APS) and ensure mission readiness. The MATOC, currently comprised of four pre-qualified contractors—Battistella S.P.A., Eiffage Infraestructuras SAU, Impresa Costruzioni Filippi Renzo e Figli, and PORR Government Services Italy SRL—remains under an indefinite-delivery, indefinite-quantity (IDIQ) structure with a five-year ordering period from March 4, 2024, to March 3, 2029. Task orders will continue to be awarded using a Lowest-Priced, Technically Acceptable (LPTA) process, where price is the sole discriminating factor after a binary technical acceptability determination, eliminating the need for certified cost or pricing data due to existing competition among the pre-vetted contractors. Work includes design-build and design-bid-build services encompassing roofing, electrical and HVAC systems, utilities infrastructure, hazardous material abatement, and facility maintenance, all subject to Army humidity control standards (≤50% RH) and compliance with 10 U.S.C. § 3204(a)(2) and DFARS PGI 206.302-2(b)(iii). Funding is drawn from Operation & Maintenance appropriations and the European Deterrence Initiative, with an increased threshold of $4 million per project under the FY24 NDAA.
