FAR Clause # Title Date Change 52.212-2 EVALUATION - COMMERCIAL ITEMS (JUN 2008) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. In determining best value to the Government, a trade-off analysis of the relative benefits and/or risk to the Government in terms of the impact on contract performance will be performed, if necessary. In performing this best value trade-off analysis, as one factor is determined substantially equal among competing offers, the other factors grow more important in making the award selection. The following factors shall be used to evaluate offers: Technical Acceptability. In order to be determined technically acceptable, offers must meet or exceed all specifications, delivery requirements, and other terms and conditions in the solicitation and any subsequent amendments. (see Proposal Submittal Requirements) If applicable, offers must also meet the requirements of FAR 52.211-6 Brand Name or Equal. The offer must be determined to be technically acceptable before being considered further. Best Value Evaluation Factors. Offers that are determined to be technically acceptable will be evaluated in terms of past performance and price. All evaluation factors other than price, when combined, are moderately more important than price. Past Performance is moderately more important than price. The evaluation factors that will be used in evaluating and determining the offer which represents the best value to the Government are listed in order of importance as stated below: 1) Technical Capability: Evaluation of technical capability will include, but not be limited to, assessment of the bid sample provided by the offeror. Bid sample will be one full kit for each Exhibit A and Exhibit B (meaning two full kits will be delivered to NSWC). 2) Past Performance: Evaluation of past performance may include, but not be limited to, relevance and extent of previous contracts, quality and conformance of supplies/services to contract requirements, timely delivery/performance, customer satisfaction, and cost control. Past performance information (PPI) utilized in the evaluation will be obtained from contractor references, PPIRS, as well as any other sources which may have relevant information. Contractor references that cannot be contacted will not be considered. Greater weight (both positive and/or negative) will be given for performance under previous contracts that are more similar in scope, size and complexity to this procurement. Those offerors with no relevant past performance information will be evaluated neither favorably nor unfavorably, however, an offer with no relevant past performance history may not represent the most advantageous proposal to the Government. Past performance evaluation will also include the extent offerors utilized small business concerns (SB, VOSB, SDVOSB, HUBZone SB, SDB, and WOSB) under previous contracts. In addition, past performance in meeting subcontracting plan goals (applicable to large businesses) will be evaluated. PPI utilized in the evaluation will be obtained from submitted Contract Data Sheets, DCMA or any other sources which may have relevant information. 3) Price: The offeror's proposed price will be evaluated for reasonableness based on price analysis. Offers will also be evaluated based on the following: (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before the award. 52.214-20 BID SAMPLES (APR 2002) - ALT II (MAY 2002) (a) Bid sample means a product sample required to be submitted by a bidder to show those characteristics of the offered products that cannot adequately be described by specifications, purchase descriptions, or the invitation for bid (e.g., balance, facility of use, or pattern). (b) Bidders must furnish bid samples as part of the bid. The Government must receive the bid samples by the time specified in the invitation for bids. If the bidder fails to submit samples on time, the Government will reject the bid, except that the Contracting Officer will consider a late sample sent by mail under the Late Submissions, Modifications, and Withdrawals of Bids provision of this solicitation. (c) The Government will test or evaluate bid samples to determine compliance with all the characteristics listed for examination in this solicitation. The Government will reject the bid when the sample fails to conform to the required characteristics. Products delivered under any resulting contract must conform to-- 1) the approved sample for the characteristics listed for test or evaluation and 2) the specifications for all other characteristics. (d) Unless otherwise specified in the solicitation, bid samples shall be (1) submitted at no expense to the Government, and (2) returned at the bidder's request and expense. 52.216-18 ORDERING (OCT 1995) (a) Any supplies or services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated. Such orders may be issued from date of award through 48 months. (b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control. (c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods. 52.216-19 ORDER LIMITATIONS (OCT 1995) (a) Minimum Order. When the Government requires supplies or services covered by this contract in an amount less than 75 Kits for CLIN 0001, CLIN 1001, CLIN 2001, CLIN 3001, and an amount less than 65 Kits for CLIN 0002, CLIN 1002, CLIN 2002, CLIN 3002, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum Order. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) above. (d) Notwithstanding paragraphs (b) and (c) above, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 1 day after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire supplies or services from another source. 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 60 days. 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 60 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 48 months. 52.252-1 SOLICITATION PROVISIONS INCORPORATED BY REFERENCE (FEB 1998) This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text.
