The U.S. Army Contracting Command - New Jersey, acting for Project Manager Soldier Lethality, awarded a sole-source Indefinite Delivery Indefinite Quantity (IDIQ) contract to Colt’s Manufacturing Company LLC for the production of M4 and M4A1 carbines to support Foreign Military Sales (FMS). This award is justified under FAR 6.302-1(a)(2)(ii)(B) because the Technical Data Package (TDP) is proprietary to Colt, making them the only responsible source capable of meeting the requirements. The contract utilizes Firm Fixed Price (FFP) delivery orders and spans five one-year ordering periods, with an anticipated award in the fourth quarter of FY2025. The scope of work includes the delivery of M4 and M4A1 carbines, first article testing units, and various spare parts. Performance takes place at Colt's facility in West Hartford, Connecticut, with inspection conducted at the origin and acceptance occurring at the destination for FMS partners. Due to the exclusive licensing agreement, Colt maintains the right of first refusal for all FMS contracts involving these weapon systems. While the contract includes requirements for small business subcontracting plans, the primary award is driven by technical exclusivity and proprietary data rights rather than a competitive trade-off or lowest price technically acceptable process.
