JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. The Office of Acquisition Management is conducting this acquisition for Support and Maintenance Agreement, Jordan Command and Control 911 Call Center on behalf of DS/T/ATA for the following country: Jordan. 2. Nature and/or description of the action being approved is the one-time justification and approval for the purchase of a Support and Maintenance agreement to Activu Corporation Federal Solutions Group, 1100 Wilson Blvd, Suite 1225, Arlington, VA. 22209 for the continued operations of the Video Wall at the Jordanian Command and Control Center, 911Call Center located in Amman, Jordan. 3. A description of the supplies or services required to meet the Department's needs. The Government has a sole source requirement to renew maintenance support for proprietary Activu software for an integrated data wall at the Jordan 911 Call Center located in Amman, Jordan. The Activu Gold Level Custom Support Plan consist of the following: 24/7 Phone Support, Access to the Activu Customer Support Web Portal, Logistical Support for Hardware Repairs and Replacement (repair/replacement hardware and shipping to be billed as actual), Free software upgrades for new versions and patches (Travel, on-site labor to install new software, and training is not included), One (1) Site Survey Visit by 2 Technicians upon Support Activation to assess and resolve issues with system, One (1) Preventive Maintenance (PM) visit, by a System Technician (Travel and Labor Included)(Annual Preventive Maintenance) - This visit will include a full re-lamping of Mitsubishi Data Wall (Travel, on-site labor and cost of replacement lamps is included), One (1) Unscheduled/Emergency on-site visit by a System Integrator (1 Total Emergency Visit). Please see attached document for definitions. 4. An identification of the statutory authority permitting other than full and open competition. 41 U.S.C. 253( C )(1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. The integrated data wall system was designed and built to the Government specifications by Activu. The software and hardware configuration are unique. Activu is the author of the Activu software used to operate the system and does not authorize third-parties to provide repair or upgrades to the Activu software. Implementing a new solution would create an unacceptable risk level. The Government would incur excessive cost for new hardware, software, training and maintenance that would not be recovered through Competition. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. This Justification and Approval will be posted on the Federal Business Opportunities website to allow interested parties to submit information for consideration by the Government. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. After reviewing invoices from other agencies who procured Activu's Gold Level Custom Support the cost to the Government will be fair and reasonable. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. Market research was conducted to determine other available data wall solutions utilized by both private and government organizations. The comparable data wall solutions either rely on a hard wire connection between terminals or utilize network software that is not compatible with the existing data wall system. Activu provides a system that is fully compatible with the existing data wall system. 9. Any other facts supporting the use of other than full and open competition. Activu Corporation is the producer of Activu and is the only provider of maintenance support for this proprietary software. In addition to authorizing the Government to use Activu software, the maintenance agreement also provides support, problem tracking, problem solving, bug reporting, patches and bug fixes, and clarification of documentation. The Government has made a significant investment in the purchase and installation of Activu and it is in the best interest of the Government to maintain this product. 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. Activu Corporation Federal Solutions Group, 1100 Wilson Blvd, Suite 1225, Arlington, VA. 22209 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Currently there are no other companies that are able to provide a network centric solution full compatible with the Activu system. Until other sources are either developed or identified no action to remove or overcome barriers can be taken at this time.
