1. Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement The Department of National Defence has a requirement for Maritime High Speed Navigation Systems (MHSNS) with software and charts integrations on an as and when required basis. The MHSNS must fit into a nine (9) meters Multi-Mission Rigid Hull Inflatable Boat (RHIB) console and withstand shock and vibration from all sea states that the craft is operating in. The MHSNS must to be waterproof and able to operate under all weather conditions since the boat design does not provide shelter. The SeaCross Marine AB MHSNS W315 15"NVIS Rugged Panel PC with sensors and accessories detailed in paragraph 3 below are the standard across the fleet and are required in order to maintain fleet interoperability. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate that they are capable of providing the following parts: 0103-01-001 SX400 - Trackball 50mm, 0103-01-001-1 SX400 Weather Box, 0103-01-003 SX450 Joystick Control, 0105-05-001 Radar Furuno NXT Radome, 0103-01-017 SX 488 8 x Keypad G1, 0106-03-004 SCX-20 N2K, 0106-01-008 UDST800, 0100-01-316 W315 15"NVIS Rugged Panel PC, 0104-01-001 SX104 MUX IP68, 0104-01-002 SX108 IP68 8 Port Ethernet Switch, - 0000-05-100 Custom Hardening Kit, 0108-04-001 Custom Cable Kit, Any interested supplier must demonstrate by way of a statement of capabilities that it can provide the following: Integration of software/ firmware, accessories and world Marine charts, Software licensing. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreement(s): Canadian Free Trade Agreement (CFTA) World Trade Organization - Agreement on Government Procurement (WTO-AGP) Canada-European Union Comprehensive Economic and Trade Agreement (CETA) Canada-Chile Free Trade Agreement (CCFTA) Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTTP) Canada-Peru Free Trade Agreement (CPFTA) Canada-Columbia Free Trade Agreement (CColFTA) Canada-Panama Free Trade Agreement (CPanFTA) Canada-Honduras Free Trade Agreement (CHFTA) Canada-Korea Free Trade Agreement (CKFTA) 5. Justification for the Pre-Identified Supplier SeaCross Marine AB is the only known supplier of the parts and services detailed in Minimum Essential Requirements at paragraph 3. 6. Government Contracts Regulations Exception The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the contract". 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the Canadian Free Trade Agreement (CFTA) – Article 513 1(b)iii: iii) due to an absence of competition for technical reasons 8. Period of the proposed standing offer agreement The proposed standing offer agreement is for a period of 3 years, with two (2) one (1) year option periods. 9. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is April 18th, 2023 at 2:00 PM. 12.
