The Department of Financial Services’ Division of Workers’ Compensation is pursuing a non-competitive, single-source procurement to acquire a three-year online subscription to Wolters Kluwer’s Medi-Span Price RX database, from September 15, 2025, through September 14, 2028. This proprietary database is mandated by Florida law to determine appropriate pharmaceutical reimbursement rates for injured workers, specifically under Florida Statute 440.13(12)(h). The subscription provides real-time access for up to 20 users, with the possibility of adding up to five licenses annually at an estimated total cost of approximately $180,358 per year, culminating in a maximum contract value exceeding $416,713 if the license cap is reached. The procurement justification hinges on the database’s exclusivity, confirmed through a letter from the vendor, and statutory requirements that restrict the use of alternative sources. The contract emphasizes the importance of statutory compliance, with the database serving as the sole authorized reference for pharmaceutical pricing calculations. The procurement process involves posting a notice of intent on the Vendor Information Portal, with a deadline for vendor responses set for December 16, 2025. As a digital service, physical packaging, labeling, or barcoding are not applicable, and the performance is evaluated based on system availability, data accuracy, and adherence to statutory mandates. The agreement’s administration is managed through designated agency personnel, including the contracting officer and designated representatives, with no specific evaluation criteria or formal key personnel requirements outlined. The procurement is structured as a fixed-term, fixed-price arrangement, justified solely by the proprietary nature of the database and legal mandates, rather than competitive evaluation or socioeconomic considerations.
