The Bay Area Air Quality Management District has issued a revised Permit to Operate to Metcalf Energy Center, LLC under Application 32239 for two natural gas-fired gas combustion turbines and two associated heat recovery steam generators located in San Jose, California. The primary objective of this action is to update the definition of the Gas Turbine Cold Start-Up Period. This clarification ensures that only startup periods requiring additional time or resulting in excessive emissions are counted toward the annual cold startup operation limit, aligning the permit with the original intent of the operational guidelines. This regulatory change was approved by the California Energy Commission on June 18, 2025, and the Air District has incorporated these conditions verbatim to establish the legal authority necessary for enforcement. The facility will maintain all existing emission limits and specified turbine capacities. Because the California Energy Commission holds plenary jurisdiction over power plants exceeding 50 MW, the Air District determined that the issuance of this permit is ministerial and exempt from the California Environmental Quality Act.
