US Customs and Border Protection (CBP) intends to negotiate on a sole source basis under the authority of FAR 6.302-1(a)(1) with Chicago Soft LTD, 4757 N. Hermitage Ave, Chicago, IL 60640 to provide annual software maintenance and product licenses for the software product "MVS/Quick-Ref". Chicago-Soft is the sole source for maintenance of the MVS/Quick-Ref software product and has the exclusive rights and full power and authority to sell, convey, license, and deliver copies of the software. The Quick Ref software requires ongoing upgrades to allow integration of information and continued enhancements for CBP systems. The period of performance will be for one year, with two one-year options. This is proprietary to the Original Equipment Manufacturer (OEM) currently supporting CBP's Office of Information Technology (OIT) hardware and software products. The purchase of any different maintenance may result in the need to replace existing serviceable equipment due to non-compatibility. Any delay resulting in the conversion to a new system may adversely impact critical mission objectives. The compatibility with existing hardware/software system configuration is limited to the "Brand Name" identified otherwise the government will incur time and cost to replace the software, which cannot be supported nor justified. Chicago Soft LTD is the only provider of this maintenance. The North American Industry Classification System (NAICS) code for this acquisition is 511210 and size standard is $35.5M. The Government intends to solicit and negotiate directly with Chicago Soft, LTD. No solicitation package will be issued. This notice of intent is not a request for competitive proposals. An award shall be made to Chicago Soft, LTD. The anticipated award date is 26 March 2014.
