National Qualified Representative Program

The U.S. Department of Justice, through its JMD-Procurement Services Staff, is seeking a contractor to deliver comprehensive legal services under the National Qualified Representative Program, targeting unrepresented, detained individuals deemed incompetent to represent themselves in immigration proceedings by an Immigration Judge or the Board of Immigration Appeals. The contractor must provide qualified personnel to deliver non-personal legal representation, interpretation services in the respondent’s native language, and access to third-party experts or services as needed. The work spans nationwide locations including detention facilities and both detained and non-detained EOIR immigration courts, requiring a robust operational framework that includes Program Operation Plans for each qualified representative organization, staffing and training protocols, data management systems, and coordination with government representatives. The contract includes a base period from August 1, 2026, to July 31, 2027, with four optional one-year extension periods through July 31, 2031, and a potential six-month service extension under FAR 52.217-8. All services must adhere to the performance standards outlined in Attachment 1 (Performance Work Statement) and Attachment 5 (Performance Requirement Standards), with delivery of monthly status reports and other required documentation by strict deadlines. The contract will be awarded as a single Firm Fixed Price agreement, with evaluation based on a best value tradeoff that prioritizes technical approach, management approach, and past performance as significantly more important than price. Offerors must submit proposals in three structured volumes: Volume I detailing technical and management capabilities including transition plans and staffing, Volume II with pricing in MS Excel format, and Volume III with past performance data on no more than three recent contracts. Proposals must be received by August 10, 2026, at 10:00 a.m. Eastern Time, remain valid for 120 days post-deadline, and comply with strict formatting rules, including 12-point Times New Roman font, single-spacing, and page numbering. Offerors must be registered in SAM with a current UEI and TIN, submit a substantively acceptable subcontracting plan to remain eligible, and comply with extensive security and privacy requirements including FISMA, NIST SP 800-53, Privacy Act, and CUI handling protocols. Personnel may require Tier 1 background investigations or SF-85P forms depending on risk level, and contractors must disclose any organizational conflicts of interest.
