Solicitation # W912DQ26RA065
The U.S. Army Corps of Engineers, Kansas City District, is soliciting design-build construction services for the installation of access manholes at the Fairfax-Jersey Creek Levee Unit on the Missouri River in Kansas City, Kansas. The project scope involves designing and constructing manholes, with estimated depths between 10 and 25 feet, to facilitate the video inspection of approximately 27,000 feet of existing perforated corrugated metal seepage collector pipe. To maintain levee integrity, the government strictly prohibits invasive mass excavation methods such as trenching, requiring the use of minimally invasive excavation techniques. Key deliverables include a Drilling and Invasive Program Plan approved by a licensed professional engineer or geologist, temporary flood protection plans, and final as-built drawings. This is a firm-fixed-price contract with an estimated magnitude between $1,000,000 and $5,000,000, though the total award amount shall not exceed $3,400,000. The acquisition is categorized under NAICS code 237990 with a small business size standard of $45 million. The selection process is conducted in two phases; Phase 1 focuses on qualifications and technical approach without pricing, from which up to three qualified offerors will be selected for Phase 2. Evaluation factors include design concepts, performance confidence, technical approach and qualifications, and small business participation, with non-price factors being significantly more important than price. Proposals must be submitted via the PIEE Solicitation Portal and adhere to strict documentation requirements, including the use of specific government templates for vendor information, experience, and technical qualifications.

Federal Acquisition Regulation (FAR) Policy states: Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects. An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for a particular project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will (1) advance the Federal Government's interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and (2) be consistent with law. Reference is made to: FAR Subpart 22.5 Use of Project Labor Agreements for Federal Construction Projects; provision, FAR 52.222-33 Notice of Requirement for Project Labor Agreement; and to clause, FAR 52.222-34 Project Labor Agreement.
