This is a mandatory test to be conducted on all newborn infants in the state of Hawaii. The statutory authority permitting this award without providing full and open competition is 41 U.S.C. 1901, as cited in FAR 13.106-1(b)(1)(i), which authorizes the government to award contracts when there is only one responsible source and no other suppliers or services will satisfy agency requirements.
