NOI - Service Agreement for Molecular Devices

The National Institutes of Health, Office of the Director, Office of Acquisitions, intends to award a non-competitive, firm-fixed-price contract to Molecular Devices for comprehensive preventative maintenance, repair services, and software updates for a Government-owned FLIPR-Tetra 96/384 instrument located at the NIEHS Main Campus in Research Triangle Park, North Carolina. This acquisition is conducted under FAR 12.603 as a streamlined solicitation for commercial services and is not expected to exceed the simplified acquisition threshold, with authority derived from 41 U.S.C. 1901 and FAR 6.302-3(a)(2)(ii) due to the exclusive capability of the manufacturer to provide certified service, OEM parts, and proprietary software. The contract includes a one-year base period beginning June 15, 2026, and four option years, potentially extending through June 14, 2031, with service delivery governed by FAR 52.217-8. All work must be performed by Molecular Devices factory-trained and certified technicians, using only OEM-certified components and diagnostic tools, with priority scheduling guaranteed for the Government to minimize instrument downtime. The contractor is responsible for maintaining a detailed, Government-owned maintenance history file documenting all inspections, repairs, and updates, which will be subject to annual review by the Contracting Officer’s Representative and fully transferred upon contract completion. Services must be delivered Monday through Friday, 7:00 AM to 5:00 PM, excluding federal holidays, at the specified NIEHS location, with FOB Destination terms placing title and risk of loss on the Government upon arrival. The offeror must be actively registered in SAM.gov with a valid Unique Entity ID and Taxpayer Identification Number, and is required to comply with Section 508 accessibility standards for all deliverables. No small business set-aside applies, and the solicitation is issued as a combined synopsis and solicitation without competition, with proposals due by June 7, 2026, submitted electronically to the designated point of contact. The contract includes clauses for SAM and CGE maintenance, commercial item terms, and statutes implemented as of March 13, 2026, with no security clearances or organizational conflict of interest mitigation required due to the sole-source nature of the award.
