Notice of Intent to Award Sole Source

The North Dakota Air National Guard intends to award a standalone, firm-fixed-price sole-source Architect-Engineer contract to Zerr Berg Architects, Inc. for Type C construction-phase services. This requirement supports a previously designed installation access-control infrastructure upgrade located at a North Dakota Air National Guard installation in Fargo, North Dakota. The intended awardee is the project's original Designer of Record, having previously performed the Type A and Type B services. The procurement is being conducted under the authority of 10 U.S.C. 3204(a)(1) and FAR 6.103-1, as the government has determined that only one responsible source can satisfy the agency's requirements. The scope of work includes comprehensive technical support throughout the construction phase, such as design-related clarifications, critical submittal and shop drawing reviews, periodic site inspections, and technical analysis for construction modifications. The contractor is also responsible for reviewing testing and commissioning information for design conformance, validating record drawings, and providing necessary project closeout documentation. Performance must align with the related construction contract period and comply with Unified Facilities Criteria, building codes, and all applicable federal, state, and local standards. While this is a notice of intent rather than a request for competitive proposals, responsible sources may submit capability statements or proposals for consideration. All responses must be submitted electronically to the designated point of contact no later than 3:00 PM Central Time on September 29, 2026.
