No entitlement to payment of direct or indirect costs or charges by the Government will arise as a result of contractor submission of responses to this announcement or the Government use of such information. This notice does not constitute a solicitation for proposals or the authority to enter into negotiations to award a contract. No funds have been authorized or appropriate for this effort.


The Department of Veterans Affairs, Network Contracting Office 21, on behalf of the San Francisco VA Health Care System, is issuing a notice of intent to pursue a non-competitive procurement with: O.R. Elder Inc. 1270 Broadway, Suite 404, New York, NY  10001. The San Francisco VA Health Care System has a requirement one (1) Voyager DSLT Laser Console (Manufacturer Part Number 900498901) and one (1) Voyager DSLT Treatments, box of 40+ 40 Speculums (Manufacturer Number 100385792). The Manufacture is Alcon.


 O.R. Elder Inc. has been determined as the only one responsible source as determined in accordance with procedures prescribed in FAR 12.102 and the anticipated contract action is hereby publicized in accordance with FAR 5.101. The purpose of this notification is to communicate the Government’s intent to solicit and award a non-competitive purchase of these items. THIS IS NOT A REQUEST FOR TECHNICAL OR COST PROPOSALS. 334510-Electromedical and Electrotherapeutic Apparatus Manufacturing). The Product Service Code (PSC) is 6515 - Medical and Surgical Instruments, Equipment, And Supplies. This non-competitive award is implemented by FAR 12.102(b), as it has been determined that O.R. Elder Inc. is Alcon Service-Disabled Veteran-Owned Small Business (SDVOSB) authorized distributor. The Government intends to procure this sole source requirement under FAR Part 12 - Acquisition of Commercial Products and Commercial Services.


This notice of anticipated contract action is published as required by 15 USC 637, USC 1708, and implemented by FAR 5.101.
