The Department of Homeland Security's Fletc Glynco Procurement Office intends to award a Sole Source Firm Fixed Price contract to the Val Verde County Detention Center (VVCDC) for detainee lodging services. This facility is expected to provide a secure and safe environment for detainees under the custody of the United States Marshals Service, specifically those awaiting transfer to other federal, state, or local authorities for legal proceedings. The VVCDC is uniquely qualified to provide these services as it is the only facility within a 70-mile radius of Del Rio, Texas, that meets the stringent Federal Performance-Based Detention Standards and offers sufficient capacity to house detainees from the Del Rio sector. The contract award is being pursued under the authority of specific federal regulations that allow for sole source contracting when only one source is reasonably available. This decision is supported by the fact that no other local facilities meet the necessary federal standards and space requirements. The United States Marshals Service will oversee compliance and conduct inspections to ensure detention standards are maintained. This notice serves as an announcement of the government's intent to proceed with a sole source contract rather than a competitive solicitation, with justification for this approach available upon request. The contracting officer has determined this is the most feasible course of action given the unique circumstances.

Full Description

Under the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1, this is to notify industry that a Sole Source Firm Fixed Price contract is anticipated to be awarded in the near future to Val Verde County Detention Center (VVCDC), for the acquisition of detainee lodging services. The facility will be responsible for providing a safe and secure environment for the care and well-being of DRT prisoners that are awaiting transfer to local, state, or other Federal agencies for the commencement of criminal and/or administrative proceedings. Non-governmental facilities that house Federal prisoners must meet Federal Performance-Based Detention Standards criteria. The United States Marshals Service is responsible for ensuring compliance, and monitoring division inspections. Currently the Val Verde Detention Center is the only facility within 70 miles of Del Rio, Texas that meet these strict standards and has enough detention space to house Del Rio Sector detainees. Because of the above stated factors, VVCDC is uniquely positioned to provide the required services, and pursuant to FAR 13.106-1(b)(1), the contracting officer has determined that the circumstances deem only one source reasonably available. A determination by the Government not to compete this proposed contract based on this notice is solely within the discretion of the Government. This synopsis does not constitute a solicitation, but is rather meant to display the Government's intent to award a sole source contract in the near future. Justification is available to be provided upon request.
