The United States Government intends to solicit and negotiate with only one responsible source under the authority of 10 U.S.C. § 3204(a)(1), as implemented by FAR 6.103-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
The Government intends to award a sole-source Indefinite-Delivery, Indefinite-Quantity (IDIQ) contract to FISICA Applied Technologies, Inc., 2700 Merced Street, San Leandro, CA 94577, for the continued supply of Original Equipment Manufacturer (OEM) replacement parts, equipment, maintenance, repair, refurbishment, calibration, upgrades, modifications, installation, certification, and related engineering services supporting Government-owned FISICA Flash X-ray Systems and Computed Radiography Systems.
FISICA Applied Technologies is the only responsible source capable of satisfying the Government's requirements because it is the OEM and owner of the proprietary technical data, engineering specifications, and intellectual property necessary to manufacture, repair, modify, certify, and support the Government's installed FISICA systems. The use of any other source would require reverse engineering or replacement of existing Government-owned equipment, result in substantial duplication of cost, and cause unacceptable delays in fulfilling the agency's mission requirements.
The proposed contract will be a five-year Indefinite-Delivery, Indefinite-Quantity (IDIQ) contract under which Firm-Fixed-Price (FFP) delivery orders and, if applicable, task orders may be issued.
This notice is not a request for competitive proposals. However, any responsible source that believes it can satisfy the Government's requirements may submit a capability statement, proposal, or quotation demonstrating its ability to meet the requirement. Responses received by the closing date of this notice will be considered by the Government solely for the purpose of determining whether competition is practicable. A determination not to compete this proposed requirement is solely within the discretion of the Government.
