NOTICE OF INTENT TO SOLE SOURCE: The U.S. Department of Homeland Security (DHS), Office of Procurement Operations (OPO), intends to negotiate a sole source procurement with Linde Gas North America, L.L.C.. (Linde), located at 1 Greenwich Street, Stewartsville, NC 08886-2020, to provide support services in the storage, handling, and shipment of Helium-3. The vendor shall store purified Helium-3 in DHS reserve storage cylinders located at Linde's facilties. The vendor shall track any Helium-3 losses that occur during the storage period. At the direction of the Government, the vendor shall ship Helium-3 to designated neutron manufacturers. DHS, OPO posted Request for Information (RFI) HSHQDC-12-R-00063, for "Commercial Sources to Purify, Handle, and Deliver Helium-3 Gas", to FEDBIZOPS on May 18, 2012. There was no response to the RFI by any organization. The associated North American Industry Classification System (NAICS) code is 325120, Industrial Gas Manufacturing, which has an annual size standard of 1,000 employees. Interested vendors must be registered in the System for Award Management (SAM) at https://www.sam.gov/portal/public/SAM/. The Government contemplates an award of a Firm-Fixed Price contract, resulting from a sole source solicitation; however, the Government reserves the right to award the type of contract most appropriate following negotiations. DHS, OPO believes Linde is the only vendor capable of satisfying this requirement. The circumstances permitting Other Than Full and Open Competition is Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source and no other supplies or services will satisfy Agency requirements." The intent of this synopsis is to determine if any sources exist, and therefore, no Request for Proposal (RFP) is available. This notice of intent is not a request for competitive quotes; however, all information received by May 20, 2013 will be considered by the Government. A determination by the Government not to compete this proposed contract action based upon the responses received from this notice is solely within the discretion of the Government. All interested vendors may submit a capability statement, proposal, or quotation to Justin Briones, Contract Specialist, by 12:00 PM Eastern Time (ET), Monday, May 20, 2013. Interested vendors shall submit this information electronically to justin.briones@hq.dhs.gov.
