--NOTICE OF INTENT TO SOLE SOURCE

ERDC Contracting Office intends to solicit on a sole source basis under the authority of FAR 6.302-1 to Power Protection Unlimited, 9351 Philadelphia Rd. STE A, Baltimore, MD 21237-4153. This procurement is being conducted under Simplified Acquisition Procedures (SAP)-only one responsible source and no other supplies or services will satisfy agency requirements. Power Protection Unlimited is the only known source capable of meeting the Governments requirements of providing an additional Uninterruptible Power Supply that will be added to an existing system currently in place. The current power protection equipment was installed and configured by Power Protection Unlimited. The new UPS system will link into the existing UPS which currently has maintenance and warranty agreement in place it. An authorized Eaton Service vendor will need to installs and services the equipment. Power Protection Unlimited is the only Authorized Service & Sales Representative in the Washington metropolitan area for Eaton Power equipment. The Government intends to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 11:00 a.m. CST 9 January 2009. Such capabilities/qualifications will be evaluated solely of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. No RFP will be issued based upon this Notice of Intent.
