Notice of Intent to Sole Source: Supplemental Services for Post Award Construction Assessment Services for the NIST Building 101 Cafeteria Renovation

The National Institute of Standards and Technology (NIST), intends to negotiate, on a sole-source basis, with DELTA ENGINEERS, ARCHITECTS, AND LAND SURVEYORS, DPC (Delta), formally known as OKKS Studios, 8401 Connecticut Ave, Suite 350, Chevy Chase Maryland 20815, to provide Post Construction Award Services (PCAS) for the Building 101 Cafeteria Renovation project on the NIST Gaithersburg campus. These PCAS services include, but are not limited to, construction progress meetings, construction observations, requests for information, construction submittal review, change orders, punch lists, record documents, substantial and final inspections. After giving fair opportunity to eligible firms, Delta was awarded Task Order to provide Architect/Engineering (AE) services for the design of renovations to the NIST Building 101 Cafeteria. The scope of the original Task Order required Delta to prepare construction plans and specifications, cost estimations, and included an option for PCAS services; however, due to funding limitations, the option for PCAS was never exercised. Now that funds have become available for the Building 101 Cafeteria renovations project, NIST requires the AE firm to provide PCAS for the pending construction that will be completed to the specifications prepared by Delta. The supplemental PCAS are considered a logical follow-on to Delta's previous Task Order SB1341-14-CQ-0029/16448 The State of Maryland requires Professional Engineers to stamp/seal and sign drawings, Delta is the Designer of Record and is, therefore, the only reasonable source to provide these services. The authority for this sole source is Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements, and utilizes the authority specified in 41 United States Code (U.S.C.) 3304(a)(1), Unique supplies or services available from only one source or only one supplier with unique capabilities. The NAICS code for this requirement is 541330, Engineering Services, with a size standard of $16.5 Million.
