The Environmental Protection Agency (EPA) plans to award a sole source fixed-price purchase order to OPNET Technologies for the annual maintenance of their hardware and software, covering enhancements, fixes, security patches, and technical support. This decision is based on the assertion that OPNET Technologies possesses exclusive rights, including copyrights, patents, trade secrets, and sole legal possession of the original source code necessary to fulfill the agency's requirements. The contract, aligned with NAICS code 443142 and subject to a size standard of $30 million, will be executed for a one-year period starting from the award date and is contingent upon the availability of fiscal year 2013 funds. In an effort to ensure no other qualified sources exist, the EPA has issued a synopsis inviting interested parties to respond within 10 days, providing detailed information about their capability to meet the requirements and itemized pricing to assess the feasibility of competition. Responses must be submitted in writing to a designated EPA official via email, excluding phone or fax communications. If no qualified responses are received, the EPA will proceed with the procurement solely with OPNET Technologies. This solicitation highlights the agency’s intent to maintain continuity and security of critical IT infrastructure through a vendor with unique proprietary rights.
