On August 12, 2019, the Naval Air Systems Command awarded a cost-plus-fixed-fee contract to The Boeing Company in the amount of 253,883.00 dollars. This action covers all Non-Recurring Engineering required to implement three specific change proposals for the P-8A Poseidon aircraft: resolving negative margin in Section 48 circumferential splices, eliminating potential structural corrosion from dissimilar materials, and addressing hinge problems and cracks on the main landing gear doors. The project was scheduled for completion by April 2020. The contract was awarded as a sole-source procurement under 10 U.S.C. 2301(c)(1) and FAR 6.302-1, as Boeing is the prime integrator and the only responsible source capable of satisfying the requirements due to proprietary technical data. A cost-reimbursement structure was selected over a fixed-price or incentive-fee arrangement because of the high level of uncertainty regarding the total effort required for development and validation. This procurement falls under the scope of FAR 16.306(b)(1)(i) for development purposes, ensuring the government pays only actual costs plus a fixed fee.

Full Description

On 12 August 2019 the Naval Air Systems Command (NAVAIR) awarded to The Boeing Company a $253,883.00 cost-plus-fixed-fee contract action for all Non-Recurring Engineering to accomplish the retrofit incorporation into P-8A Poseidon aircraft of the following three change proposals: (1) Negative Margin Resolution Sect 48 Circumferential Splices, (2) Eliminate Potential Structural Corrosion from Dissimilar Materials, and (3) Eliminate Hinge Problems & Cracks on MLG Doors. The effort is to be completed by April 2020. The effort was procured pursuant to 10 U.S.C. 2301(c)(1) and FAR 6.302-1, "Only One Responsible Source and No Other Type of Supplies or Services will Satisfy Agency Requirements." The effort entails too much uncertainty to warrant a fixed price contract type. A cost reimbursement contract type is the most appropriate contract type for this effort because it is unknown how much effort will be required to complete the effort and the value of the procurement action renders the use of a cost-plus-incentive fee (CPIF) contract type impractical. This procurement falls within the scope of FAR 16.306(b)(1)(i) for CPFF application purposes because the contract is for development (in terms of developing, validating and furnishing a kit for the Government to verify each TD for each CP). At this stage of the effort, there are no reasonably firm performance objectives and schedules appropriate for utilizing a CPIF contract. In this application, a CPFF contract type ensures that the Government is not paying more than actual costs incurred (along with fixed fee), and prevents the contractor from realizing excessive profit while still receiving the required support needed to complete the NRE associated with the retrofit incorporation of each of the three CPs. Therefore, a CPFF contract is the most appropriate contract type for this work. This notice is for information purposes only.
