The Naval Air Systems Command awarded a cost-plus-fixed-fee delivery order to The Boeing Company for non-recurring engineering related to the design, fabrication, and deficiency correction of retrofit kits for United States Navy P-8A aircraft. This effort specifically supports the delivery and installation of Increment 3 Engineering Change Proposal 6 capabilities. The contract was executed as a sole-source procurement under the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1, as Boeing is the original designer, developer, manufacturer, and sole integrator of the P-8A aircraft and possesses proprietary technical data that is unavailable to the government. The cost-plus-fixed-fee structure was selected to ensure an equitable allocation of program risk between the government and the contractor, given the inherent uncertainties associated with the Increment 3 development requirements. This action falls under Class Justification and Approval 19-0326, which authorizes sole-source actions for A-Kits and initial retrofit modifications with an authority expiration date of September 30, 2025. The procurement is managed by the Department of Defense through the Naval Air Systems Command office located in Patuxent River, Maryland.

Full Description

The Naval Air Systems Command (NAVAIR) awarded a cost-plus-fixed-fee (CPFF) delivery order for the procurement of non-recurring engineering for design, fabrication, and correction of deficiencies required for the delivery and installation of retrofit kits for United States Navy (USN) P-8A aircraft with Increment 3 Engineering Change Proposal (ECP) 6 capabilities. The effort was procured pursuant to 10 U.S.C. 2304(c)(1) and FAR 6.302-1, "Only One Responsible Source and No Other Type of Supplies or Services will Satisfy Agency Requirements." The Boeing Company is the original designer, developer, and manufacturer of the P-8A and its sole integrator. Aside from the configuration and non-commercial and commercial technical data associated with each aircraft excluding the test instrumentation, the Government does not possess any technical data associated with the test instrumentation nor can the Government acquire the necessary data. It was determined that a CPFF contract action was the appropriate contract type pursuant to DFARS 235.006(b)(ii) (A). This is a development program for which the use of a fixed-price type contract would not provide an equitable and sensible allocation of program risk between the Government and the Contractor due to the uncertainties related to the Increment 3 requirements.
