AI Contract Overview

This contract involves a sole-source procurement by Lee County Fleet Management for the purchase of original equipment parts and services specifically for engines used in their fleet of off-road equipment. The procurement is designated as a sole-source because Kelly Tractor, Inc. is the only authorized dealer capable of supplying genuine OEM parts and performing repairs for Caterpillar engines, which are critical to maintaining the fleet’s operational integrity. The equipment includes twenty-two off-road units manufactured by Caterpillar, along with several other pieces powered by Caterpillar engines from various manufacturers. The justification for exclusive sourcing hinges on Caterpillar’s restrictions on distribution of proprietary parts, diagnostic software, and technical support, which are only accessible through authorized dealers like Kelly Tractor. This arrangement ensures that repairs meet strict quality standards, preserve warranties, and prevent potential safety or operational issues caused by substandard parts or unauthorized repairs. The procurement process emphasizes compliance with Lee County’s policies, with the intention to utilize a sole-source approach to ensure reliability and efficiency in servicing the fleet. Interested vendors who believe they can meet these requirements are invited to contact designated procurement officials for review. The contract value is estimated to range between $500,000 and $1.5 million, reflecting the scope of parts and services needed. This initiative aligns with the county’s broader commitment to maintaining a dependable fleet, minimizing downtime, and ensuring safety and operational efficiency for public service operations in the region. The contract details, including the solicitation number, response deadlines, and contact information, are publicly available for transparency and vendor engagement.

***THIS IS NOT A BID***   The description of services intended for purchase from a sole source is posted in accordance with section 3.9, Procurement Ordinance 23-21 and will be posted for a minimum of 15 business days.   Commodity or Service Required: Purchase of Original Equipment Parts and Service for Engines.   Description: Lee County Fleet Management seeks to execute a sole-source procurement for Purchase of Original Equipment Parts and Service for engines by Kelly Tractor, Inc. These original engine parts are used for our Fleet containing twenty (22) off-roads pieces of equipment that are manufactured by Caterpillar. We also have several pieces of off-road equipment produced by various manufacturers that are powered by Caterpillar engines. These units require OEM (Original Equipment Manufacturer) parts and lubricants to complete repairs. Certain parts are not available from any after-market parts source. Kelly Tractor Inc is the only authorized dealer in Lee County that can supply these items.   Intended Sole Source: Kelly Tractor, Inc.   Justification for Sole Source Acquisition: Kelly Tractor, Inc. is the only qualified supplier possessing the unique and singular available capacity to meet the requirements of the department. Only an OEM dealer of Caterpillar equipment, such as Kelly Tractor, can supply parts and repairs for a fleet of Lee County equipment because Caterpillar restricts the distribution of genuine OEM parts and proprietary service information exclusively to its authorized dealers, ensuring that all components meet stringent quality standards, maintain warranty validity, and guarantee compatibility with the equipment's design specifications. Non-authorized suppliers often lack access to these proprietary resources, including specialized diagnostic software, factory training for technicians, and direct technical support from Caterpillar, which could result in substandard repairs, increased safety risks, higher long-term maintenance costs, and potential voiding of warranties on Lee County's fleet. This exclusive arrangement is further justified by Lee County's procurement practices, which recognize Kelly Tractor as the sole authorized provider in the region for Caterpillar products, allowing for efficient, reliable service that minimizes downtime and supports the operational needs of public services in Southwest Florida.   Recommended Procurement Approach: For the reason(s) stated above, Lee County Procurement Management intends to utilize the Sole Source Procurement method to purchase from Kelly Tractor, Inc.to supply the above.   Respond to: If your firm feels they have the ability to supply the above, please contact Ana Reynoso and Kevin Walker, Lee County Procurement Management at areynoso@leegov.com and KWalker2@leegov.com for review.
