R--Notice of Sole Source Award

The Department of Energy, Procurement Services Division, Acquisitions Office, extended a Task Order by means other than full and open competition. An approved Limited Source Justification sets forth the justification and approval for award of a Federal Supply Schedule order on a Limited-Source basis as required by FAR 8.405-6. FAR 8.405-6(a)(1)(1)(B), only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. The original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures and was not previously issued under sole-source or limited sources procedures. All Schedule awardees were given a fair opportunity to be considered for the original order. This justification is in the support of a new follow-on FSS order, for a period of 6-months, to IBM. This requirement is to ensure that there is not a break in service which will Impact FE's mission during the protest process of the follow-on contract. The services currently being performed under this contract were previously awarded to TMS, who was later bought out by IBM. The contract underwent a re-compete and a new contract was awarded to ADS on September 16, 2014. On September 22, 2014 a size protest was filed with the Smail Business Administration. IBM is the only source available to perform the stated requirements of the SOW from October 31, 2014 to end of the protest process, estimated to be 3 to 6 months. The dollar value of this action (including options) is $1,851,991.00. This special notice is not a solicitation for firms to submit proposals.
