The Office of Federal Housing Enterprise Oversight (OFHEO) plans to negotiate a sole source contract with the law firm Duane Morris to continue providing legal services related to the Special Examination of Fannie Mae. This continuation is necessary because the work involves complex issues such as accounting practices, internal controls, and executive compensation, all of which Duane Morris has already extensively analyzed and developed under the existing contract. The firm’s unique expertise and familiarity with the case’s facts and evidence make it the only qualified contractor capable of meeting the statutory deadlines associated with this matter. The new work will be integrated into the current contract with Duane Morris, emphasizing the continuity and efficiency of legal services. Given the specialized nature of the investigation and the time-sensitive requirements, OFHEO recognizes that maintaining the existing relationship with the incumbent contractor is essential. This arrangement underscores the agency’s need for legal counsel deeply versed in the specific and technical aspects of the Special Examination of Fannie Mae to ensure compliance and thorough examination within the designated time frame.

Full Description

The Office of Federal Housing Enterprise Oversight (OFHEO) intends to negotiate with Duane Morris, on a sole source basis, for the continuation of legal services arising out the Special Examination of Fannie Mae. The work will be incorporated into the existing contract with Duane Morris because it involves the same issues and evidence, including accounting practices, internal controls and executive compensation, as the firm developed in connection with the examination. The continuation of these legal services requires the expertise they alone have due to their performance on the current contract; the incumbent contractor is the only contractor sufficiently versed in the issues and facts to perform the services within the time required given the statutory deadlines presented in the matter.
