Regional Primary Juvenile Delinquency Defender

The State of Utah, through the Division of Purchasing and the Department of Criminal Justice, is seeking to award a three-year contract for the provision of legal defense services to juveniles referred to the 6th Judicial District, under the title Regional Primary Juvenile Delinquency Defender. The contract, solicited under CS27-4, anticipates multiple awards and is budgeted at $100,000 annually, for a total estimated value of $300,000, subject to legislative appropriations. Respondents must be either a solo legal practitioner or a law firm with two or more attorneys, all of whom must maintain an active license and good standing with the Utah State Bar, and must comply with the IDC’s Core Principles for Appointed Attorneys Representing Youth in Delinquency Proceedings. The scope of work requires comprehensive representation of youth from intake through disposition and post-disposition matters, including client interviews, legal research, court advocacy, collaboration with social services, case documentation, and adherence to ethical standards set by the Utah State Bar and Supreme Court. Performance must occur within the 6th Judicial District, with all services delivered under the State’s Standard Terms and Conditions, which govern contract execution, including indemnity, confidentiality, termination rights, and intellectual property protections. Proposals must adhere to strict submission protocols, including separating cost and technical responses, and providing both redacted and non-redacted versions if business confidential information is included—failure to comply results in non-responsiveness. Evaluation is structured around pass/fail gates and weighted technical and cost factors: vendors must achieve a minimum technical score of 210 points to advance, with points awarded for resume quality, statement of interest, and youth defender experience tied to IDC principles, each weighted at 20 points out of a possible 100 per criterion; cost is weighted far more heavily at 300 points, calculated using a ratio formula based on the lowest proposed price. Contractors must also carry workers’ compensation, commercial general liability of at least $1 million per occurrence and $3 million aggregate, and commercial automobile liability of $1 million per occurrence if vehicles are used. They are subject to background checks for site access, must certify compliance with Utah’s anti-boycott statutes, avoid forced labor or restricted foreign entities, participate in E-Verify for employee eligibility, and obtain prior written approval for any publicity.
