NOTICE FOR FILING AGENCY PROTESTS United States Coast Guard Ombudsman Program It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time- consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman. Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable). Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester's concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency's goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted electronically to OPAP@uscg.mil and the Contracting Officer or by hand delivery to the Contracting Officer. Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting Officer or the Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed. The Ombudsman Hotline telephone number is 202.372.3695. This notice is prepared in accordance with (IAW) FAR 5.207 and is not a Request for Proposal (RFP). RFP number 70Z03818RH0000003 is assigned for tracking purposes only. The United States Coast Guard (USCG), Aviation Logistics Center (ALC), requires depot level repairs of various AN/APY-11 Multi-Mode Radar (MMR) System components through the award of one Firm Fixed-Price (FFP), Indefinite-Delivery, Requirements-type contract. A Field Service Representative (FSR) is also required to provide the ALC Long Range Surveillance Division (LRS) with subject matter expertise, technical support and technical training for ALC, the Aviation Technical Training Center (ATTC), and USCG Air Stations. This is a notice of the Government's intent to award one (1) contract on a sole source basis to EDO LLC, Defense Systems, division of Harris Corporation, 1500 New Horizon Boulevard, Amityville, New York 11701-1130 (CAGE 82340) for FSR support and repair of the following avionics equipment: Description National Stock Number Part Number EL/M-2022A Radar Transmitter 5999-01-HS2-0750 1021J200-001 EL/M-2022A Radar Receiver Processor 5841-01-HS2-0459 1021J400-001 (or) 1021J400-002 EL/M-2022A Front End Receiver 5999-01-HS2-0749 1021J500-001 EL/M-2022A Radar Antenna 5999-01-HS2-0751 1021J100-001 EL/M-2022A Drive Amplifier Unit 5999-01-HS2-0752 1021J520-001 (or) 1019A550-001 EL/M-2022A Internal Measurement Unit 5999-01-HS2-0742 1003U495-001 RF Assembly 6120-01-HS2-8071 1020F220-001 (or) 1019A220-001 LVCU, CCA 6120-01-HS2-8072 5002L000-005 (or) 5002L000-004 (or) 5002L000-003 Power Supply, Switching 5930-01-HS2-4341 1015D580-001 Power Supply, Linear 5930-01-HS2-4340 1015D420-001 RDP, CCA 5963-01-HS2-4304 1013E460-001 I/O Module 5963-01-HS2-4305 1019A470-001 (or) 1019A470-002 RSP, CCA 5963-01-HS2-4227 1013E420-002 RFT, CCA 5963-01-HS2-4307 2015A720-001 ADCP, CCA 5963-01-HS2-4308 1019A480-002 (or) 1017A480-003 RCVR, CCA 5963-01-HS2-4309 1093E405-002 (or) 1093E405-003 Synthesizer, CCA 5963-01-HS2-4310 1093M002-003 (or) 1093M002-004 TX-OSC, CCA 5963-01-HS2-4311 1093E705-003 Low Amp Module 5998-01-HS2-5845 1092N830-001/A (or) 1092N290-001 (or) 1092N290-001/A (or) 1093N310-001/D HVB, CCA 6120-01-HS2-8070 1012B400-003 (or) 1012B400-002 (or) 1012B400-001 Repairs for the MMR System components and FSR services are commercial items IAW FAR 2.101 and are used in support of the Coast Guard's HC-130J aircraft.
