The Naval Air Systems Command plans to issue a delivery order to The Boeing Company’s Derivative Aircraft Programs Division in Seattle for the repair or replacement of C-40A combination components. This order will be awarded on a sole source basis under FAR Part 12 commercial contracting procedures due to Boeing being the Original Equipment Manufacturer (OEM) and the sole provider of the C-40A aircraft. The C-40A is a Federal Aviation Administration certified, commercial derivative cargo and transport aircraft, modified with Navy-specific features such as a cargo door and handling system. Since Boeing holds the unique commercial data and proprietary information necessary for this work, no other suppliers can meet these requirements, leading to an other than full and open competition award, anticipated around July 31, 2008. The original contract for the C-40A was competitively awarded to Boeing in Fiscal Year 1997, and this follow-on order is essential for maintaining or upgrading the aircraft’s specific components. No solicitation document will be issued, and while this notice is not a request for competitive proposals, the Government will review any responses within fifteen calendar days of this notice to determine if a competitive procurement is warranted. The award will be conducted under FAR 6.302-1, which allows for contracting with only one responsible source when no alternatives are available, ensuring operational and logistical continuity for the Navy’s fleet. The contract is managed by the Naval Air Systems Command office in Patuxent River, Maryland, with points of contact available for further information.
