The contract pertains to the procurement process for outside legal counsel to handle Public Information Act (PIA) appeals for the Public Utility Commission of Texas. The agency regularly processes PIA requests and, when it determines that responsive information may be protected under exceptions outlined in Texas Government Code Chapter 552, it seeks guidance from the Office of the Attorney General (OAG) by requesting a letter ruling. If the PUCT disagrees with the OAG’s ruling or decision, it has a ten-day window to file a petition for a declaratory judgment in district court to assert an affirmative defense. Additionally, the agency has thirty days from receipt of the OAG’s ruling to file an appeal, ensuring it can challenge or uphold the legal interpretation as needed. The solicitation, titled "Request For Qualifications (RFQ) For Outside Legal Counsel In Public Information Act Appeals," was posted on July 5, 2025, with a response deadline of August 7, 2025.
