Right of Entry Permit to San Diego County Regional Airport Authority for Least Tern Monitoring at Chula Vista Wildlife Reserve

The San Diego County Regional Airport Authority is granted a Right of Entry to access designated property within the Chula Vista Wildlife Reserve in Chula Vista, California, for the sole purpose of conducting Least Tern monitoring services mandated by the Endangered Species Act in support of approved Airport projects under the Immediate Action Program of 1992. This access includes necessary ingress and egress for authorized personnel, agents, and contractors to carry out these monitoring activities, with no new development, construction, or expansion of the affected area permitted under the agreement. The permit is time-limited to approximately five years or until the monitoring work is completed, whichever comes first, and is strictly confined to the existing scope of activities without altering the land use or physical footprint of the reserve. The San Diego Unified Port District, as the property owner, retains the right to terminate the Right of Entry at any time with twenty-four hours’ written notice, and the Airport Authority may also terminate the agreement without cause under the same conditions. The agreement does not include financial compensation or construction obligations, and its intent is purely operational and environmental in nature. All activities must comply with federal wildlife protection statutes and are coordinated through the Port District’s designated point of contact, Kelly Cunningham, with oversight provided by senior administrative personnel to ensure compliance and minimal impact on the reserve’s ecological integrity.
