The State of Utah Division of Purchasing, on behalf of the Utah Department of Corrections, is seeking multiple vendors to provide second market food products, including surplus, short-dated, overstock, and closeout items. This five-year contract aims to reduce procurement costs while maintaining strict nutritional and safety standards. Awarded vendors will compete via subsequent quote requests, with purchase orders issued to the lowest-priced technically acceptable quote. Deliveries are required for both Region 1 and Region 2 on an FOB Destination basis, with a lead time of 7 to 14 days. All products must be delivered in manufacturer standard packaging and comply with FDA, FSMA, and USDA or CDFA food safety requirements, including specific allergen labeling and expiration date declarations. The selection process involves a three-stage evaluation. First, proposals are screened for minimum mandatory requirements. Second, a technical evaluation scores vendors on company experience, product sourcing and quality, food safety and compliance, and logistics, requiring a minimum score of 700 out of 1,000 points to proceed. Third, a separate cost evaluation assigns points based on the lowest proposed price. A combined technical and cost score of at least 875 points is required for a contract award. Vendors must guarantee pricing for three months and adhere to various state and federal mandates, including Utah's anti-boycott Israel statute, E-Verify registration, and comprehensive insurance coverage including Commercial General Liability of at least 1 million dollars per occurrence.

Issuing Procurement Unit: State of Utah Division of Purchasing Conducting Procurement Unit: Utah Department of Corrections (UDC)
The purpose of this RFP is to enter into multiple contracts to provide: Second Market Food Products
It is anticipated that this RFP will result in multiple contract awards. Subsequent order placements will be conducted via competitive quote requests among all awarded contracts, with purchase orders issued to the lowest-priced technically acceptable quote.
The methodology or formula that will be used to determine the number of contract awards is:
Stage 1: Initial Review In the initial phase of the evaluation process, the conducting procurement unit will review all proposals timely received and meet Minimum Mandatory Requirements (MMRs). Non-responsive proposals not conforming to RFP requirements or unable to meet the mandatory minimum requirements will be eliminated from further consideration.
Stage 2: Technical Proposal Evaluation Responsive proposals will then be evaluated by an evaluation committee appointed by the conducting procurement unit against the proposal evaluation criteria noted in the Technical Criteria prerequisite of this RFP. Proposals will be evaluated against the evaluation criteria as follows:
Evaluation Criteria Points:__ 1) Company Experience__100 Points Possible 2) Product Sourcing & Quality__400 Points Possible 3) Food Safety & Compliance__300 Points Possible 4) Logistics & Distribution__200 Points Possible Total Points Available via Technical Scoring – 1,000 Points Possible
*Offerors must obtain score of 700 points (70%) to move to the final cost evaluation stage.
Stage 3: Cost Evaluation
The Offeror with the lowest total cost will receive the maximum points of 250. Points assigned to each Offeror’s cost proposal will be based on the lowest proposal price. The Offeror with the lowest total cost will receive 250 or 100% of the total cost points. All other Offerors will receive a portion of the total cost points based on what percentage higher their total cost is than the total lowest cost. The formula to compute the points is: Cost Points x (Lowest Proposed Price/Proposed Price).
Pursuant to Utah Code Annotated (UCA) § 63G-6a-707(7), the cost proposal will be evaluated independently from the technical proposal, and as such, must be submitted separately from the technical proposal. Offerors must not include costs or pricing data in their responses to the Mandatory Minimum Requirements and the Technical Response.
Offerors with a score of less than the minimum required technical points will be deemed non-responsive and ineligible for further consideration. Any proposal that receives 875 total points from the combined technical and cost scores will be awarded a contract. The evaluation score sheet has been attached to this RFP. The attached evaluation score sheet states the relative weight that will be given to each evaluation criteria.
Length of Contract: 5 Years.
Vendor must guarantee its pricing for 3 Months
