This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is 192113NFU0000336 and is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-69. The associated North American Industrial Classification System (NAICS) code for this procurement is 332994 with a small business classification size of one thousand (1,000) employees. This requirement is a small business set-aside and only qualified offerors may submit a quote. Requirement Description: DHS/ICE is seeking quotes for two thousand four hundred (2,400) Sig Sauer P239 Pistol Magazines, .40 Caliber, Blue. Associated Product # MAG-239-40-7. No alternative product quotes will be considered. Delivery Requirements: Delivery must be made 30 Days after receipt of order (ARO). The vendor may not substitute any item listed on this order without prior written approval from the DHS/ICE Contracting Officer. No other individual is authorized, either verbally or in writing to change part numbers, manufacturer, quantity, delivery dates, or any other specifications of this RFQ. Items/services that do not conform to descriptions and part numbers found in this RFQ will be rejected at the time of delivery causing a return at the vendor's expense. Brand Name Justification: The Sig Sauer P239 Pistol Magazine (.40 Caliber, Blue), Product #MAG-239-40-7 is the only authorized pistol magazine specifically designed for use in the ICE issued/authorized Sig Sauer P239 Pistols. This product must be original equipment manufacturer (OEM) for function, reliability, warranty, and liability purposes. This product is currently specifically authorized by ICE policy. Evaluation Procedures: An award will be made to the responsive offeror (who submits all required submissions on time), whose past performance does not pose a risk to the Government, and whose offer is the Lowest Price Technically Acceptable (LPTA). An offer is technically acceptable if its technical capabilities conform to the Government's Statement of Work or listed specifications whichever is applicable to the buy.
