AI Contract Overview
The Navy is procuring a single high-impact shock battery, model 18-G75-27EE, manufactured by East Penn Manufacturing Co. (CAGE 04055), under a sole-source solicitation due to its classification as a Critical Safety Item essential for forklift operations aboard MSC vessels, where only the original equipment manufacturer is authorized to supply such components. The requirement is being pursued under a firm-fixed-price contract consistent with RFO Part 12, with the anticipated award date set for May 2026. Offers must be submitted electronically by May 22, 2026, to the designated contracting officer, and while the Government is not mandating competition, responses will be evaluated to determine whether competitive procedures should be pursued. The evaluation will include price reasonableness and past performance for responsibility determination, with award expected to be based on a trade-off approach, considering overall value rather than strictly lowest price. Delivery is due by December 3, 2026, to DLA Disposition Services in San Diego, California, under FOB Destination terms, and must be shipped using packaging and marking that comply with MIL-STD-2073-1, MIL-STD-129R, and MIL-STD-130 for unique item identification, including mandatory two-dimensional Data Matrix symbology with specified data elements encoded using Format 05, 06, or 12. All packaging must meet ISPM-15 standards for wood materials, and each container must be clearly labeled with the vessel name, hull number, and purchase order details in stenciled letters. The battery must be uniquely identified per DFARS 252.211-7003, without any issuing agency code, and all shipments must be tracked via a unique package identifier. Acceptance will occur at the delivery site by the Government, using DoDAAC N62387, and no functional performance testing criteria are specified beyond compliance with packaging, marking, and identification standards. Invoices must be submitted electronically via WAWF using approved DoDAACs N50082 or N62387, and contractors must be registered in SAM.gov, comply with cybersecurity requirements under DFARS 252.204-7012, and affirm in writing that they are not providing covered telecommunications equipment from foreign entities prohibited by DFARS 252.204-70
