This Special Notice issued by the Bureau of the Fiscal Service addresses the temporary nationwide preliminary injunction affecting the enforcement of Executive Order 14042, which mandates COVID-19 safety protocols for federal contractors. The notice applies to contractors and subcontractors working with various federal agencies and informs them that due to certain court orders, the government will not enforce the requirements of the Executive Order in specific U.S. states or outlying areas where the order's application has been prohibited. For contracts with performance locations in these excluded areas, the COVID safety protocol clauses will not be enforced, and new contracts or solicitations for work exclusively in these locations will either omit such clauses or have them removed through amendments. For all other contracts and solicitations outside the excluded states or areas, the government will continue to enforce the Executive Order's requirements. The notice clarifies that for any contract extensions, renewals, or new awards involving a place of performance in an excluded state or area, no enforcement action will be taken unless further notice is provided. A current and updated list of excluded states and areas is maintained on the Safer Federal Workforce website. The Bureau of the Fiscal Service will update this special notice as needed, and questions should be directed to the respective Contracting Officers handling these contracts.
