AI Contract Overview
The Export-Import Bank of the United States is issuing a sole-source follow-on contract under FAR 6.302-1 to La Cima International for asset protection and recovery services related to defaulted loan claims in El Salvador, specifically Claim Nos. I201089 and I201090. This award is justified due to the continuity of an ongoing recovery process, the unique qualifications of the incumbent vendor, and the limited pool of providers with deep expertise in the El Salvador judicial system. The contract requires the contractor to perform non-personal services including asset searches, site visits, negotiations, litigation, drafting and enforcing restructuring agreements, embargoes, and asset execution, all while maintaining full knowledge of and active registration within El Salvador’s legal framework. The contractor must be a duly qualified and registered attorney in El Salvador if litigation is pursued, and key personnel must possess appropriate credentials and judicial registration to perform legal work. Performance is measured through a detailed Performance Requirement Summary with ratings ranging from Exceptional to Unsatisfactory, based on strict thresholds such as response timeliness exceeding 99.8% for litigation, professional conduct, and proper management of credentials. The contract duration is five years, with performance occurring in both Washington, D.C., and El Salvador, and includes mandatory semi-annual reporting meetings with EXIM’s recovery officer and Office of General Counsel, one in each location. The contractor is compensated solely through a contingency fee structure based on a percentage of actual cash recoveries, with no upfront payments or guaranteed funding; extraordinary expenses must be pre-approved in writing. Surveillance and quality assurance are conducted monthly by the COR, with 100% inspection of deliverables and regular evaluations to ensure compliance with performance standards. The contracting office is located at 811 Vermont Ave., NW, Washington, D.C. 20571, with Travis Finkle as the primary point of contact, and the NAICS code is 541110 with a $16 million size standard, though no competitive solicitation was issued due to the sole-source nature under FAR 16.505(2)(c).

Synopsis – 83310126Q0043 | Claim(s) in El Salvador (Follow-on)
EXIM Bank, headquartered in Washington, D.C., is providing this notice of intent to issue a sole source a follow-on award to provide asset protection and recovery services.
The applicable Product/Service Code is R418.
The applicable North American Industry Classification System (NAICS) code is 541110 - Offices of Lawyers, which has a size standard of $16M.
This requirement is to assist EXIM in its efforts to collect outstanding amounts owed to EXIM by the obligor/buyer and all guarantors, if any. These efforts will include, as EXIM may direct, asset searches, site visits, negotiations, litigation, documentation of agreements, embargoing assets and executing upon assets. See attached PWS.
When an individual AMD recovery contract ends but the recovery action is still pending resolution, we award follow-on contracts on a sole source basis to the original vendor (per FAR 16.505(2)(c)) as long as it is for the same recovery case(s). The rationale for this is the combination of contingency payment agreement and the frequent long length of the recovery process. With limited vendor availability, if we did not follow this practice, the original vendor could perform most of the work and the subsequent vendor would reap the rewards of any funds recovered. By awarding follow-on contracts in this manner, we establish fairness for the vendors in an unusual situation, retain good relations with a limited vendor pool for future needs, and therefore get the best long-term benefit to the government.
