In 2007, Article 10 of the New York State Mental Hygiene Law was enacted as part of the Sex Offender Management and Treatment Act (SOMTA). The legislature found that “recidivistic sex offenders pose a danger to society that should be addressed through comprehensive programs of treatment” (MHL § 10.01). At that time, existing criminal processes were enhanced and civil measures advanced to supplement the State’s efforts to provide meaningful responses to the risks to public safety posed by certain sex offenders.The legislature determined that “the system should offer meaningful forms of treatment to sex offenders in all criminal and civil phases, including during incarceration, civil commitment and outpatient supervision” (MHL § 10.01). Article 10 provides for either confinement of certain sex offenders in an OMH secure treatment facility or management in the community under Strict and Intensive Supervision and Treatment (SIST).
