The Department of State’s Utility Intervention Unit (UIU) is tasked with representing consumer interests in the regulation of electric and gas markets in New York, serving as the Statewide Consumer Advocate before the Public Service Commission and the NYISO. The UIU collaborates with other sector members, including NYSERDA and various consumer advocates, to develop positions that protect end-use customers. Funding for the UIU’s consumer advocacy efforts was secured through a $10 million award from the Federal Energy Regulatory Commission, resulting from a settlement agreement, to enhance its capacity in wholesale electric markets. To fulfill its objectives, the UIU contracted with Daymark Energy Advisors and PSM Consulting for specialized services in energy, capacity, electric, and planning issues, with these contracts initially spanning five years from July 1, 2020, to June 30, 2025. A six-month extension has been granted for both contracts, which are awarded as sole-source due to the providers being the only qualified recipients. The current contract, titled "UIU Constellation NCTE," is set to extend until March 27, 2025, covering all counties across New York State and functioning statewide. The contract’s estimated value ranges from approximately $9 million to $11 million. This procurement was awarded as a single-source contract, exempt from advertising requirements, with the primary point of contact being Coleen Kern at the Department of State. The contract aims to support ongoing advocacy and coordination efforts related to energy markets, ensuring the UIU can effectively represent consumer interests in regulatory proceedings and market developments.

The Utility Intervention Unit (“UIU”) of the Department of State (“DOS”) has the statutory responsibility to represent the interests of consumers before the Public Service Commission (“PSC”) and the New York Independent System Operator (“NYISO”). The Board of Directors of the NYISO has also designated UIU as the Statewide Consumer Advocate when participating in matters before the NYISO. In this role, the UIU serves as a member of the End-Use Consumer Sector. In addition to UIU, members of this sector include the New York State Energy Research and Development Authority (“NYSERDA”), Multiple Intervenors, Consumer Power Advocates, and the City of New York. These members discuss issues and develop positions that advance the interests of end-use customers. As a result of a settlement agreement between the Federal Energy Regulatory Commission (“FERC”) and a market participant, DOS was awarded $10 million in funding for the specific purpose of strengthening the UIU’s wholesale electric markets consumer advocacy. After completing a competitive solicitation process, UIU contracted with Daymark Energy Advisors focusing on energy, capacity, and electric gas coordination issues, and one contract with PSM Consulting to cover planning issues. These contracts were for a five-year term from July 1, 2020 to June 30, 2025.  This is a six-month extension for the planning contract and of the energy and capacity market contract. Reason for advertising exemption: Single Source Award recipient: Daymark Energy Advisors and PSM Consulting Any questions or comments regarding this notice of sole-source, single-source, or procurement otherwise exempt from advertising in the NYS Contract Reporter should be directed to the contact person listed for the contracting agency or public authority.
