The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), National Capitol Acquisition Division (NCAD), specifically the Simplified Acquisition Branch intends to negotiate on a sole source basis with L- Communications Klein Associates Inc. using the procedures in FAR Parts 6 and 13. The DOC, NOAA, National Ocean Service (NOS), Coast Survey Development Lab requires the upgrade/modification of a government-owned Klein 5000 V2 Bathy Hydrographic Sonar System (S/N 184 AND 364) and repair of a government-owned Klein Transceiver Processor Unit (TPU) (S/N 139) as follows: replace Transceiver Processor Unit (TPU) Demux board with new HC 5000 TPU Demux board; replace tow body with a HydroChart Sonar Head Unit integrated with an Applied Microsystem MicroSV sound velocimeter and install a new CPU board upgrade. L-3 Communications Klein Associates Inc. is the only party known to NOAA who can provide the required upgrades and modifications since they are the manufacturer of the Klein Model 5000 and all Klein 5000 system upgrades/modifications are provided solely by L-3 Klein due to the proprietary nature of the technology. The statutory authority for other than full and open competition is 41 USC 253(c) (1) as implemented by FAR 6.302-1, Only one responsible source. The North American Industry Classification Code (NAICS) for this acquisition is 334511 with a small business size standard of 750 employees. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the foregoing requirements. Responses must also be accompanied by descriptive literature, warranties, and/or other information that demonstrates that the quote meets all of the foregoing requirements. Capability statements and related materials must be e-mailed to contact@example.gov <#> or faxed to +1 (555) 000-0000 by May 24, 2010. Award will be made using FAR 13, Simplified acquisition procedures, current through FAC 2005-40. The determination to compete or not compete the proposed order based upon responses to this notice is solely within the discretion of the Government.
