UDOT Notice of Sole Source- 5 Year Service DSR 102e
Solicitation # UDOT270013BGSS
The Utah Department of Transportation (UDOT) is proposing a sole-source award for a five-year service contract to maintain and repair specialized asphalt binder testing equipment, specifically the Anton Paar DSR 102e and GMH3710 instruments, with a contract value of $56,500. This procurement is being conducted without competitive bidding due to the proprietary nature of the equipment, which only the original manufacturer, Anton Paar, can service, including access to proprietary parts, software, and diagnostic tools. UDOT has determined that transitioning to an alternative vendor would incur significant operational disruption and transitional costs, making a standard procurement process impractical and contrary to the best interests of the agency. A public notice has been issued to allow interested parties to challenge the sole-source justification by demonstrating they can provide an equivalent service, complete with a cost-benefit analysis showing the financial impact of switching vendors. The contract will be awarded only after the public comment period ends on July 21, 2026, and no valid challenge is submitted. Performance will occur within Utah, with services provided either on-site at UDOT facilities or at the vendor’s location under F.O.B. Destination, Freight Prepaid terms. No detailed pricing structure, line items, or federal contract clauses are provided; instead, the award is grounded in compliance with Utah Code Section 63G-6a-802, requiring documentation of market exclusivity, transitional cost analysis, and disclosure of any financial relationships between the vendor and procurement personnel. The contract may be issued as an agency contract or purchase order, subject to formal approval by UDOT Procurement, and no federal representations, certifications, or socioeconomic designations are required.
