The U.S. Department of the Interior’s United States Geological Survey, Upper Midwest Environmental Science Center, intends to enter into a sole source contract with BioSonics, Inc. for leasing specific proprietary acoustic equipment and software. This contract involves a 9-week lease of one DT-X surface unit with BioSonics Acquisition Software, accompanied by associated transducers, cables, and mounts, as well as an additional 6-week lease of two DT-X surface units with software and a full complement of transducers, cables, and mounts. BioSonics equipment is the exclusive provider of this specialized technology, which is proprietary and essential to maintain data integrity and project consistency, particularly given USGS's existing inventory of equipment from this vendor. The sole source approach is justified by the unique qualifications and proprietary nature of BioSonics hardware and software, the absence of other authorized resellers, and the necessity of consistency with existing USGS equipment to avoid data discrepancies. Interested firms were invited to submit capability statements by April 29, 2013, for consideration, though this notice did not represent a formal solicitation. The Government reserves sole discretion over competition decisions and will bear no costs related to responses. The contract aligns with NAICS code 339920 and originates from the Department of the Interior's Office of Acquisition Grants, headquartered in Reston, VA.

The reasons justifying this lack of competition is based on the following description of the specific qualifications the Government requires of the BioSonic software, transducers, sensors and accessories to meet its minimum need, and the factors the Government will use to evaluate the information submitted by firms in response to this Notice: All BioSonics equipment and software is proprietary in nature, and USGS currently owns equipment that was purchased through this vendor, and any remaining necessities must be purchased from this vendor as well. The USGS has no knowledge of authorized resellers of BioSonics equipment. The use of this equipment and software will maintain the integrity of the data and the project, to ensure that there is no conflict in the standards. In order to be responsive to this Notice, a firm must provide the appropriate capability statement for consideration by 10:00 am (MT) on April 29, 2013. Responses that do not comply with these procedures will not be considered. Requests for information and subsequent responses may be emailed or mailed to the point-of-contact specified below. Firms are cautioned that this is not a solicitation. All costs associated with providing information as requested by this notice shall be the responsibility of the responding firm. D--Intent to Award
Solicitation # 140G0126Q0188
The U.S. Geological Survey intends to award a sole source purchase order to EarthScope Consortium, Inc. for the long-term archiving, curation, and dissemination of continuous Global Navigation Satellite System data generated by USGS-supported monitoring stations, with a period of performance spanning from August 1, 2026, through June 30, 2031, including four one-year option periods. This action is justified under FAR 13.106-1(b)(1) due to EarthScope Consortium’s unique status as the sole nationally recognized, USGS-approved repository for GNSS data that meets the agency’s Fundamental Science Practices requirements for trusted, discipline-appropriate data management. EarthScope operates the GAGE geophysical data facilities, which already provide scalable, production-level infrastructure, standardized workflows, and metadata frameworks used by USGS and other federal and academic partners, eliminating the need for redundant or incompatible systems. The decision follows comprehensive market research that confirmed no other entity can provide equivalent services without prohibitive cost, delay, or fragmentation of data standards. The requirement includes routine annual archiving for active stations and a single ingestion of historical data from a legacy station, with all services delivered through an existing, certified cyberinfrastructure that ensures data integrity and broad accessibility. EarthScope’s established role as the primary national hub for GNSS data, its deep integration with USGS science operations, and its proven compliance with federal data governance policies make it the only viable source for this critical function. The contracting office has determined that competition would be impractical due to the specialized technical, scientific, and infrastructure requirements, and future competitions would only be considered if new repositories are formally recognized as meeting USGS FSP standards or if the agency develops an internally managed archive of equivalent capability. Questions regarding this intent to award must be submitted to the Contract Specialist by June 29, 2026, and the action will proceed under simplified acquisition procedures without soliciting competitive bids.
