Requested services (1 line item): - Category 1 — Data Transmission And/Or Internet Access — Standalone Data Transmission Service
State/local procurement requirements: Restrictions and Procedures These Restrictions and Procedures apply uniformly to all prospective bidders and are intended to ensure compliance with applicable E-Rate, state, and local procurement requirements. ----- To be considered, all correspondence, questions, and bid responses must be directed to the Technical Contact and must copy the Form Contact listed on this Form 470. SPAM and/or automated robotic responses will not be considered valid and will be disqualified. ----- All bidders must: - Comply with all applicable E-Rate rules and regulations. - Possess a valid Service Provider Identification Number (SPIN) and submit an annual Service Provider Annual Certification (SPAC Form 473) for the current Funding Year and throughout the contract term. - Be able to process reimbursement via the Service Provider Invoice (SPI Form 474) method and agree to accept only the E-Rate discounted share plus any ineligible costs, unless otherwise specified by the applicant. - Provide all required E-Rate documentation (including but not limited to Program Integrity Assurance [PIA] responses) upon request. - Provide an annual breakdown of eligible costs for services and/or equipment to support BEAR (Form 472) submissions, if applicable. - Offer Lowest Corresponding Price (LCP) as defined in the FCCs Fourth Report & Order (FCC-97-420). ----- Additional requirements: - Vendors must agree to establish billing accounts and/or invoices by site location and/or service, at the entitys sole discretion. - By submitting a quote, vendors agree to provide a la carte pricing. The entity may increase, decrease, or eliminate quantities or services without changing the per-unit cost. - Quotes and proposals shall be considered binding contracts if signed by the applicant within the stated proposal timeframe, or within twelve (12) months of receipt if no expiration is specified. - If Installation and Initial Configuration is checked as Yes on the Form 470, the entity reserves the right to disqualify any bid that does not include these services. - Any proposal including gray-market equipment or lacking required certifications/documentation may be disqualified. - Vendors debarred from Federal, State, or Local agencies are prohibited from bidding. - All purchases must comply with applicable state and local procurement laws. - Unless otherwise stated, vendor proposals are due no sooner than 28 days after this Form 470 posting. The entity reserves the right to accept or reject proposals received on or after the Allowable Contract Date (ACD). ----- Contingencies: - Awarding of bids and any ensuing contracts is contingent upon approval of E-Rate discounts and/or the availability of budgeted funds. - If any provision of this section is deemed invalid or unenforceable by a court of competent jurisdiction, such provision shall be stricken, but all remaining provisions will remain in full force and effect. ----- Submission of a response, quote, or proposal indicates the vendors acceptance of these terms.
