The Federal Bureau of Prisons (BOP) is proceeding with a sole source procurement for a software upgrade on the Government-owned Varian Varis Record and Verify system at the Federal Medical Center in Butner, North Carolina. This upgrade pertains to the transition to the Aria patient management system and will be provided exclusively by Varian Medical Systems, the sole manufacturer of the compatible upgrade kit. The contract, valued at $38,922, involves software support and enhancement of the existing Eclipse and Record and Verify systems used in oncology patient treatment. Due to the proprietary nature of the software and regulatory restrictions from the FDA, no other supplier can provide a compatible upgrade. The procurement is justified under the Federal Acquisition Regulation (FAR) Part 6.302-1(b) and statutory authority 41 U.S.C. 253(c)(1), allowing for other than full and open competition. A notice of intent to award a sole source contract was published, but no alternative sources have expressed interest or capability. The contracting officer has determined that the cost is fair and reasonable based on comparable software system upgrades. Because the upgrade is an FDA-approved proprietary solution, no further market survey was conducted, and no efforts to overcome competition barriers are planned at this time. The award will be made promptly following the public notice period in accordance with FAR Part 13 Simplified Acquisition Procedures.
